(AP) ? A Chinese court on Wednesday began hearing Apple's appeal of a ruling against its right to use the iPad trademark in China.

Apple Inc. is in several legal battles with Proview Electronics Co., which the U.S. company says sold it the rights to the iPad trademark in 10 different countries, including China, in 2009. Apple contends that Proview has refused to honor the agreement and has not indicated any willingness to settle with Proview, a maker of computer monitors and LED lights.

Walking into the Guangdong High Court in the southern Chinese city of Guangzhou on Wednesday, lawyers for Proview expressed confidence, but also indicated the company remained open to settling with Apple.

"I don't rule out the possibility," Xie Xianghui, a lawyer representing Shenzhen Proview Technology, the company's main Chinese subsidiary, told reporters.

On Tuesday, Proview announced it was seeking to regain worldwide rights to the iPad name and is suing Apple Inc. in the U.S. for alleged fraud and unfair competition, hoping to have a 2009 sale of the trademark ruled void. Proview was previously only claiming rights to the iPad name in China.

Apart from having the trademark sale voided, it also is seeking unspecified compensation, a share of Apple's profits from alleged "unfair competition" and an order for Apple to stop using the trademarks.

So far, two lower courts in Guangdong have sided with Proview on the issue, while a Hong Kong court ruled in Apple's favor. Last week, Shanghai's High Court rejected Proview's effort to get Apple to stop selling the popular tablet computer under the iPad name.

Proview, once a major computer monitor manufacturer, launched a device it called iPAD, or Internet Personal Access Device, in 2000 but it was not a market hit. Apple launched its popular iPad tablet in 2010.

Proview contends Apple intentionally misled it when it bought iPad trademarks through a special purpose company called IP Application Development Ltd. that concealed it was acting on Apple's behalf.

Experts in the high-tech field say such tactics are common given the secrecy surrounding new product launches, especially Apple's.

(AP) ? Meryl Streep might join the acting three-peat club with a third Academy Award. Jean Dujardin could become the first Frenchman to win best actor. Christopher Plummer is in line to become the oldest acting winner ever at 82.

And "The Artist" is favored to become the only silent movie to take the best-picture prize since the first Oscar ceremony 83 years ago.

Along with Streep, Hollywood's big night on Sunday has plenty of returning stars, too, with past Oscar winners and nominees such as George Clooney, Brad Pitt, Glenn Close, Michelle Williams and Nick Nolte in the running again.

The show also has a returning favorite as ringmaster: After an eight-year absence, Billy Crystal is back for his ninth time as host.

Because of a change in voting rules, the Oscars feature nine best-picture nominees for the first time, instead of the 10 they had the last two years.

Competing against "The Artist" for the top honor are Clooney's family drama "The Descendants"; the Deep South tale "The Help," featuring best-actress nominee Viola Davis and supporting-actress favorite Octavia Spencer; and the Paris adventure "Hugo," from director Martin Scorsese.

Also in the lineup: the romantic fantasy "Midnight in Paris," from writer-director Woody Allen; Pitt's baseball tale "Moneyball" and his family saga "The Tree of Life"; the World War I epic "War Horse," directed by Steven Spielberg; and Tom Hanks and Sandra Bullock's Sept. 11 story "Extremely Loud & Incredibly Close."

"Hugo" leads with 11 nominations, with "The Artist" right behind with 10.

Spencer's a virtual lock for supporting actress, having dominated earlier film honors for her breakout role in "The Help" as a brash maid in 1960s Mississippi. The same holds true for Plummer, the front-runner for supporting actor for his role as an elderly widower who comes out as gay in "Beginners."

The lead-acting categories are where the drama lies. Best actress shapes up as a two-woman race between Davis as a courageous maid leading an effort to reveal the hardships of black housekeepers' lives in "The Help" and Streep as British Prime Minister Margaret Thatcher in "The Iron Lady."

The record-holder with 17 acting nominations, Streep has won twice and would become only the fifth performer to receive three Oscars. Jack Nicholson, Ingrid Bergman and Walter Brennan all earned three, while Katharine Hepburn won four.

It's been almost three decades since Streep last received an Oscar, for 1982's "Sophie's Choice." Though she has the most acting nominations, she also has the most losses ? 14. Another loss would be her 13th in a row.

Best actor also looks like a two-person contest between Clooney as the distressed patriarch of a Hawaiian clan in "The Descendants" and Dujardin as a silent-era superstar whose career tanks as talking pictures take over in "The Artist."

It would be the second Oscar for Clooney, who won the supporting-actor prize for 2005's "Syriana." While French actresses have won before, among them Marion Cotillard and Juliette Binoche, Dujardin would be the first actor from France to receive an Oscar.

Dujardin was picked as best actor Saturday at the Spirit Awards honoring independent film, where "The Artist" ruled with four prizes, including best picture and director for Michel Hazanavicius, who is favored for the same trophy at the Oscars.

"The Artist" has dominated Hollywood honors this season, winning key prizes at the Golden Globes and awards shows held by the Directors, Producers and Screen Actors guilds.

"This means a lot, because it's a small movie. It's not expensive. We did it with small money," Hazanavicius said backstage at the Spirit Awards. "And it's black and white and silent."

If "The Artist" comes away with the best-picture trophy, it would be the first win for a silent film since the war story "Wings" was named outstanding picture at the inaugural Oscars in 1929.

The 84th Academy Awards show begins at 8:30 p.m. EST, broadcast live on ABC from the Hollywood & Highland Center in Los Angeles.

Newly arrived Reyes creates buzz at Marlins' camp

JUPITER, Fla. - Despite a new haircut and new uniform, Jose Reyes was easy to recognize on his first day at spring training Thursday.

Several dozen fans shouted Reyes' name as they clustered along a practice-field fence at the Miami Marlins' complex, and when he walked over to sign autographs, the tumult resembled a New York subway station at rush hour.

"Don't push! Don't push!" one fan said.

"Make a line, for God's sake!" said another.

That's why the Marlins signed Reyes: to cause a commotion. They figure he'll do it on the bases, leading off and using his speed to disrupt defenses, like last year with the New York Mets when he won the NL batting championship.

There's also the Big Apple-style buzz he's bringing to the Marlins, a franchise in transition after finishing last in NL attendance each of the past seven years. The Marlins anticipate sellout crowds this season in their new ballpark, and they're being touted as potential playoff contenders thanks to an offseason spending spree.

The biggest deal was a $106 million, six-year contract for Reyes, and the shortstop already ranks among the most popular players with Marlins fans. His No. 7 jersey has become a common sight in Miami.

"They haven't seen me play here yet," he said. "When they see me play, they're going to fall in love with me, because I'm a guy who gives 100 percent every day."

They loved him in New York, where he made the All-Star team four times and hit .337 last season with 39 steals and an NL-high 16 triples.

He had been with the organization since age 16, but the cash-strapped franchise didn't make a serious offer when he became a free agent this offseason. Marlins officials began courting him in person at a New York hotel at midnight, only moments after the signing period began.

He sealed his deal with Miami at the winter meetings, and Reyes is now so eager to start earning his big salary that he reported for camp three days before the first full-squad workout.

"This is my new team, my new family," he said. "It's a good feeling."

Reyes sported closely cropped hair after having his dreadlocks shorn to comply with the Marlins' dress code. He said he likes the new look, but his daughter needed time getting accustomed to it.

"The first couple of days when I went home, I said to my daughter, 'Come on over,' and she was like, 'This is my daddy?'"

While Reyes spoke at his locker, two stalls away slugger Hanley Ramirez sat and listened. Ramirez is reluctantly moving from short to third base to make room for Reyes and said he welcomes the addition of his fellow Dominican.

"He's going to help this team in many ways, because he's a winner," Ramirez said. "When you've got a guy like him who brings a lot of energy from the clubhouse to the field, it's going to be great."

While Ramirez has drawn criticism for his effort and attitude, the genial Reyes enjoys a reputation for always playing hard. He's also injury-prone, and hamstring injuries hampered him each of the past three seasons, but the Marlins aren't inclined to discourage him from diving or sliding.

However, they will give him a breather on occasion, manager Ozzie Guillen said.

"You cannot change this guy and the way he plays," Guillen said. "We'll give him a few days off. Every time he's on the bench he'll be making $2 million just sitting next to me, and that's hard if you're the owner and you see that. But that's the way it's going to be."

Ramirez will not be Reyes' backup at shortstop, Guillen said. The manager wants Ramirez to focus on learning how to play third.

When they're both out there, Reyes said, the left side of the infield will rival any in the majors.

"We can be very good, the best," he said. "We can do some special things."

They mostly went their separate ways during informal drills Thursday. At the fence by the practice field, Reyes signed balls, bats, hats, photos and baseball cards, then walked away to a chorus of thank-yous.

"Have fun in Miami, Jose," one fan shouted.

Bigger crowds await there. The buzz for the Marlins' new shortstop is only beginning to build.

Cupcake Diaries: Crock Pot Honey Sesame Chicken

I love finding new recipes that are not only delicious to everyone in my family but also super simple to make! My crock pot and I are good buddies and I'm super thrilled every time I find a new recipe that involves it.

Sadly, not all crock pot recipes are good. But I'm happy to say that this one is SO awesomely delicious. It's quite a delight! And you can just throw everything in without looking back. No sauteing the chicken first or anything like that. Score!

Crock Pot Honey Sesame Chicken
Very Culinary
makes about 4 servings

  • 1 1/2 lb. thawed chicken thighs or breasts
  • salt and pepper
  • 1 c. honey
  • 1/2 c. soy sauce (I like to use low sodium.)
  • 1/2 c. diced onion
  • 1/4 c. ketchup
  • 2 Tbsp vegetable oil or olive oil
  • 2 cloves garlic, minced
  • 1/4 tsp. red pepper flakes
  • 4 tsp. cornstarch dissolved in 6 Tbsp of water
  • 1/2 Tbsp (or more) sesame seeds
  • 3 scallions, chopped

Directions

  1. Lightly season both sides of the chicken with salt and pepper and put into the crock pot.
  2. In a medium bowl, combine honey, soy sauce, onion, ketchup, oil, garlic, and pepper flakes. Pour over the chicken and cook on low for 4 hours.
  3. Remove the chicken from the crock pot, leaving the sauce. Dissolve 4 tsp. of cornstarch in 6 Tbsp of water and pour right into the crock pot. Stir to combine with the sauce. Replace the lid and cook sauce on high for 10 more minutes or until slightly thickened.
  4. Cut or shred the chicken into bite size pieces. Then in individual bowls or on plates, place the chicken pieces over cooked rice and spoon some sauce on top. Sprinkle with sesame seeds and chopped scallions.

Keep in mind, if you have a family of picky eaters or you are a picky eater yourself, you don't have to add ingredients like onion and scallions. However, you may want to sprinkle onion powder or something similar in with the sauce mixture to give it a little extra flavor.

(AP) ? Federal prosecutors investigating the West Virginia coal mine explosion that killed 29 men are working their way up the corporate ladder with criminal charges.

On Wednesday, the former superintendent of the Upper Big Branch mine became the highest-ranking company official charged in the 2010 disaster, and he is apparently cooperating with prosecutors, who said the investigation is far from over.

Gary May, 43, was charged with conspiracy to defraud the government, accused among other things of disabling a methane gas monitor, falsifying safety records and using code words to tip off miners underground about surprise inspections.

He could get up to five years in prison if found guilty.

The only other Massey Energy employee prosecuted so far in the nation's deadliest mining disaster in four decades is former mine security chief Hughie Elbert Stover, who will be sentenced next week for lying to investigators and trying to destroy documents.

Prosecutors are urging a federal judge to make an example of Stover by giving him the maximum ? 25 years in prison.

The charges against May were contained in what is known as a federal information, a document that typically signals a defendant is cooperating with prosecutors. Reached at his home Wednesday, May declined to comment.

U.S. Attorney Booth Goodwin said his investigation is "absolutely not" finished, but he would not comment further. Prosecutors routinely cut deals with lower-ranking figures to help them build cases against higher-ranking ones.

Clay Mullins, who worked at Upper Big Branch and lost his brother Rex in the blast, said more people deserve to be prosecuted, including former Massey CEO Don Blankenship.

"I want to see some other names," he said. "There were a lot of people involved in this, and I just want to see them be punished for the crimes."

Prosecutors have refused to say whether they are targeting Blankenship, a hard-nosed executive whose company was cited for violations so frequently that union critics accused him of regarding fines as simply the cost of doing business.

Blankenship, once one of the most outspoken leaders in the coal industry, retired months after the explosion and moved away from West Virginia. A telephone number for him could not be found, and he has all but disappeared from public view since the blast.

A United Mine Workers report said Blankenship was among 18 Massey employees who invoked their right against self-incrimination and refused to cooperate with any of the investigations.

Alpha Natural Resources of Bristol, Va., bought Massey and all its operations, including the Upper Big Branch mine, last summer.

Prosecutors have accused Massey of violating a host of safety laws out of a desire to put production and profits first.

Three investigations of the tragedy concluded that the company allowed highly explosive methane and coal dust to build up inside the mine, where it was ignited by a spark from an improperly maintained piece of cutting equipment.

Clogged and broken water sprayers then allowed what could have been just a flare-up to become an epic blast, the investigations found.

Prosecutors said May manipulated the mine ventilation system during inspections to fool safety officials and disabled a methane monitor on a cutting machine a few months before the explosion. It wasn't clear from court papers whether the device was ever fixed.

Although other mine accidents have led to criminal charges, prosecutors have typically targeted low-ranking employees.

"I hope they can go up, and I think they will," said Gary Quarles, whose son Gary Wayne died in the explosion.

Quarles said he was surprised the charges reached so high into the ranks.

"It's about time," he said. "It's a good start."

Naseer Mehdawi, Anthony Shadid's closest Iraqi friend and journalism colleague, recalls their friendship and how together they told the story of Iraq.

Reporters are cantankerous, competitive and frequently catty. Yet Anthony Shadid's sad and untimely death has brought forth nothing but praise and admiration from every corner. An old friend reminded me yesterday of a conversation in 2006 in which I told her that "Shadid, hands down, is the best reporter working in Iraq." I suspect all of us who covered the war there said that at one time or another. Like all of us, of course, he had help, particularly from Naseer Mehdawi, the Iraqi colleague who worked with him on the stories that landed Anthony the 2004 Pulitzer.

I remember the first time I met Anthony Shadid in February 2003. I had been working for The Washington Post in Baghdad with Rajiv Chandrasekaran and the photographer Michael Robinson Chavez. Anthony had joined Rajiv and me and Chavez. Rajiv introduced Anthony to me and told me that he was a great journalist. He had been working with another paper, but the Post hired him because he is the best. Then orders came from Phil Bennett, who was the Post?s assistant managing editor for foreign news at the time, that all the journalists of the Post should leave Iraq because the troops were gathering in the Gulf and the war would happen. But Anthony refused. He stayed and asked me if I would like to stay with him. I was very interested in journalism and looking at what might happen. Rajiv left with Chavez to wait in Kuwait. (They later returned after the war started.) It was only me and Anthony. Our driver was Karim Sadon. After that we were pretty much Anthony?s team, me and Karim. Everyone at the Post knew that we were Anthony?s guys.

I started my journey with Anthony looking for people expressing their feeling about what would happen. I had an instinct that the regime would collapse. I made up my mind to help him and support him. I took Anthony to Kadhamiya, a large Shiite neighborhood in Baghdad. All the people there hated Saddam because he was targeting them and killed many of their families during the uprising after the 1991 Gulf War. When I told Anthony about this, he was happy about the tip, and he started to get closer to me, to count on me. I had begun to think like Anthony, to know the kinds of stories he wanted, the people he wanted to meet. Anthony liked talking to people on the streets, the real people who were affected by Saddam and affected by the war. His confidence in me became stronger.

I remember that Saddam?s Information Ministry gave us an order to go to specific places. We refused. We went to forbidden places that no one dared to go except me and Anthony. At restaurants we?d talk about where to go next, all the places Saddam did not want us to see. We set out on daily trips with our brave driver, Karim, going to various parts of the country, meeting people, discussing issues, and making friends. We met workers at factories, farmers in the fields, government employees who were fed up with the restrictions of the regime, university students aspiring for an opportunity to be free and express their woes and dreams, clerics secluded inside their small mosques, and just simple, down-to-earth people. We listened to stories of women who had lost their husbands and sons in the many wars waged by the regime.

Unemployment gap in education shrinks in US

Unemployment gap based on levels of education is wide in the United states. That unemployment gap is still quite large, but it got smaller in 2011.

In March last year I discussed?that the United States has an unusually large gap in rates of employment and unemployment based on the level of education. In most countries such data aren't available, but in two Asian countries where it is available, South Korea and Taiwan, there was virtually no difference at all, at least in unemployment.

The U.S. gap remains very large, but it has actually dropped during the latest year. Between January 2011 and January 2012, the unemployment rate dropped by 1.2 percentage points for high school dropouts from 14.3% to 13.1%, 1 percentage point for people with only a high school diploma from 9.4% to 8.4%, 0.9 percentage points for people with "some college" from 8.1% to 7.2% while being unchanged at 4.2% for people with a bachelor's degree or more.

The trends in the participation rate (which mostly reflects trends in "hidden" unemployment) reinforces these trends, so the difference in the changes for employment rates is even bigger. The employment rate for high school dropouts rose by 1.1 percentage points from 38.6% to 39.7%, for people with only a high school diploma it was unchanged at 54.6%, for people with "some college" it fell from 64.5% to 64.2% while the employment rate for people with a bachelor's degree or more fell from 73.2% to 72.4%.

Given that the big gap was for reasons I explained in?my original post?mostly irrational, it is good that this convergence happens, at least to the extent that it reflects higher employment and lower unemployment among people with little education. While it is natural that people with a higher education should on average earn more, this should manifest itself in terms of higher wages or salaries for highly educated compared to persons with little education, not higher unemployment for people with little education.

A beautiful family film based on THE BORROWERS will delight audiences of all ages

The Secret World of Arrietty is an engaging and warm story of a lovely friendship that has enough action and humour to satisfy all ages, and boy, it's awfully pretty.

While perfectly pleasant and an entirely suitable option for anyone looking to take small children to the movies, it is a disappointingly minor entry in the annals of Studio Ghibli...

An oasis of calm in the normally hyperactive world of toon entertainment.

That relaxed pace allows the story to breathe?forget the franticness of most American animation?and along with the gorgeously detailed art, lush color, and swoony music...the film is all but guaranteed to entrance children.

How sad that such efforts rarely find the audience they deserve.

Like its title character, it's a small tale told with a lot of heart, and for those looking for a throwback to non-computer-animated films, this could be your answer. (Parental Movie Review also available)
